1. Introduction
Welcome to Agri Solsec. These Terms of Service ("Terms") govern your access to and use of the website at agrisolsec.co.za, our online store, and all related content, products, services, tools, and features we make available (collectively, the "Services"). By accessing or using the Services, placing an order, or creating an account, you agree to be bound by these Terms and by our Privacy Policy and Return Policy.
If you do not agree with these Terms, you must not use the Services. We may update these Terms from time to time as set out in section 16 below.
These Terms do not affect your statutory rights as a consumer under the South African Consumer Protection Act, 2008 ("CPA"), the Electronic Communications and Transactions Act, 2002 ("ECTA"), or any other applicable law.

3. Eligibility
By using the Services, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract. If you are using the Services on behalf of a business or other entity, you confirm that you are authorised to bind that entity to these Terms.
4. Accounts
You may browse parts of the Services without creating an account, but certain features (such as order tracking and saved addresses) require one. When you create an account you agree to:
- Provide accurate, current and complete information;
- Keep your login details (including your password) confidential;
- Notify us promptly at agrisolsec@gmail.com if you suspect unauthorised access to your account; and
- Accept responsibility for all activity that occurs under your account, except to the extent caused by our breach of these Terms or applicable law.
We may suspend or terminate your account if we reasonably believe you have breached these Terms or used the Services unlawfully.
5. Products, Pricing & Availability
We make reasonable efforts to ensure that product descriptions, photographs, specifications, and prices on the Services are accurate. Despite our best efforts:
- Product images are illustrative and may differ slightly from the actual item delivered (for example, packaging revisions, mounting hardware variations, or minor cosmetic changes from the manufacturer);
- Specifications, firmware features, and battery or panel performance figures are based on manufacturer data and may change without notice;
- Stock availability is shown in good faith but is not guaranteed until your order is confirmed and paid for; and
- Prices are listed in South African Rand (ZAR) and include VAT where applicable, unless otherwise stated. Shipping costs are calculated separately at checkout.
We reserve the right to correct any pricing or product errors and to update prices at any time prior to accepting your order. If we discover an error in the price of a product you have ordered, we will contact you and give you the option to confirm the order at the corrected price or cancel it for a full refund.
6. Orders & Acceptance
When you place an order through the Services, you are making an offer to buy the listed products at the listed price. Your order is only accepted, and a contract of sale is only formed, when we send you an order confirmation by email confirming that the order has been accepted and the products have been (or are about to be) dispatched.
We may, at our sole discretion, decline or cancel any order — including after a confirmation has been sent — in cases such as:
- The product is unavailable or has been discontinued;
- The price or product description was clearly incorrect;
- We suspect fraudulent activity, payment fraud, or unauthorised use of a payment card;
- You have not met any condition we have communicated for the order; or
- We reasonably believe the order is intended for resale on terms that breach our supplier agreements.
If we cancel an order after payment has been received, we will refund you in full to the original payment method.
7. Payment
We accept the payment methods displayed at checkout, which may include credit and debit cards, instant EFT, and other Shopify-supported payment options. All payments are processed by third-party payment service providers, and you agree to be bound by their terms.
By submitting payment details, you confirm that you are authorised to use the payment method and that the funds are sufficient to cover the order. We do not store full payment card details on our own servers.
8. Shipping & Delivery
We ship throughout South Africa via reputable couriers. Shipping options, costs, and estimated delivery timeframes are shown at checkout and on our Shipping Policy page where available. Delivery times are estimates and not guaranteed; rural and farm deliveries in particular may take longer due to courier route schedules.
Risk of loss and title for products pass to you upon delivery to the address you specified at checkout. Please inspect your order on delivery and notify us within a reasonable period of any visible damage or missing items, as set out in our Return Policy.
9. Returns, Refunds & Warranties
Returns, exchanges, and refunds are governed by our Return Policy, which forms part of these Terms.
Subject to our Return Policy and your statutory rights under the CPA, products are sold with the implied warranty of quality, suitability and durability set out in section 56 of the CPA for a period of six (6) months from delivery. Where a manufacturer's warranty applies in addition (for example on solar panels, cameras, or pumps), the manufacturer's terms will be supplied with the product or are available on request.
Nothing in these Terms is intended to limit any right or remedy you may have under the CPA or any other applicable law.
10. Acceptable Use
You agree to use the Services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of them. In particular, you agree not to:
- Use the Services to break any law or regulation, or for any fraudulent or harmful purpose;
- Resell or commercially exploit any portion of the Services or any product purchased through us in a way that breaches these Terms;
- Attempt to gain unauthorised access to any portion of the Services, our systems, other users' accounts, or related infrastructure;
- Introduce any viruses, malware, or other harmful code; or
- Scrape, harvest, or otherwise systematically extract data from the Services without our prior written consent.
11. Intellectual Property
All content on the Services — including text, graphics, photographs, product images, the Agri Solsec name and logo, designs, layout, software, and the selection and arrangement thereof — is owned by or licensed to Agri Solsec and is protected by South African and international intellectual property laws.
You may view, download, and print pages from the Services for your personal, non-commercial use only. You may not otherwise copy, reproduce, modify, distribute, publicly display, or create derivative works from any part of the Services without our prior written consent.
If you believe any content on the Services infringes your intellectual property rights, please contact us at agrisolsec@gmail.com with details of the alleged infringement.
12. User-Generated Content
If you submit reviews, photographs, comments, or other content to the Services ("User Content"), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify, publish, and display that User Content in connection with the operation and promotion of the Services.
You are solely responsible for any User Content you submit. You confirm that you own or have the necessary rights to submit it, and that it does not infringe any third party's rights or breach any law. We may remove any User Content at our discretion.
13. Disclaimers
The Services and all products are provided on an "as is" and "as available" basis, except to the extent that any warranty, condition, or other term is implied by the CPA or any other applicable law that cannot lawfully be excluded.
We do not warrant that the Services will always be available, uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any specific product will achieve a specific outcome on your farm or property — for example, particular detection ranges, deterrence effects, or pumping volumes — as those depend on factors such as installation, environmental conditions, sunlight, and connectivity that are outside our control.
14. Limitation of Liability
To the maximum extent permitted by law, Agri Solsec, its directors, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, loss of data, loss of livestock or crops, business interruption, or property damage — arising out of or in connection with the Services or the use of any product purchased through us, even if we have been advised of the possibility of such damages.
Without limiting the above, our total aggregate liability to you for any claim arising out of or relating to these Terms, the Services, or any product purchased through us will not exceed the total amount you paid for the product or service that gave rise to the claim.
Nothing in this section excludes or limits our liability for fraud, gross negligence, wilful misconduct, death or personal injury caused by our negligence, or any other liability that cannot be excluded under South African law (including under the CPA).
15. Indemnification
You agree to indemnify and hold harmless Agri Solsec, its directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Services or any product purchased through us; or (c) your violation of any law or third-party right.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business, the Services, or applicable law. The updated version will be posted on this page with a revised "Last updated" date. Material changes will be highlighted at the top of the page or notified to account holders by email where appropriate.
Your continued use of the Services after we post an update constitutes your acceptance of the updated Terms.
17. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or relating to these Terms or the Services will be subject to the non-exclusive jurisdiction of the South African courts.
Before commencing any formal proceedings, we encourage you to first contact us at agrisolsec@gmail.com so we can try to resolve the matter informally. As a consumer, you may also have the right to lodge a complaint with the National Consumer Commission or another competent body under the CPA.
18. Severability & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be replaced with a valid provision that most closely reflects the original intent.
These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Agri Solsec relating to the Services and supersede any prior agreements between you and us on the same subject.
